January 5, 2010 Board Meeting Agenda Item #18 Title APPROVAL OF SETTLEMENT AGREEMENT AND RELEASE Description Sam Rodgers Properties, Inc. is the developer of the Hatchett Creek at Jacaranda DRI.  Prior to the imposition of educational impact fees and as a condition of the DRI, Rodgers made a cash donation of $350,000 to the School Board to offset expected educational impacts of the development.  Subsequently, the educational impact fee ordinance was enacted, including a provision for credits/reimbursement for prior, pre-impact fee contributions.  Rodgers has sought reimbursement and the settlement agreement reimbursing Rodgers the amount of $165,000 has been negotiated by counsel for the School Board and Rodgers. Recommendation That the School Board approve the Settlement Agreement and Release with Sam Rodgers Properties, Inc. as presented.
